Estate / Probate

Estate Planning

Estate / ProbateWe appreciate that everyone has unique details in his or her life which vary how an estate should be drafted. We firmly believe that your estate, no matter how big or how small, is comprised of things you love and for which you have worked your entire life. Therefore, you may dispose of your estate however you desire. We take the time to review and discuss your assets and wishes in order to tailor your estate documents to your specific situation. This level of care ensures that your estate is handled precisely in accordance with your desires. In addition, this review often reveals simple, cost-effective steps which can be taken now to avoid a problem with probate in the future. We draft the following estate planning documents:

• Last Will & Testaments for estates valued under $5 million dollars
• Last Will & Testaments with provisions for special needs beneficiaries
• Financial Powers of Attorney
• Durable Powers of Attorney for Health Care
• Advanced Health Care Directives
• Living Wills
• Quitclaim Deeds

Probate

We help those who are grieving the loss of a family member or friend and who are facing the often daunting task of probating an estate. We take the stress off of you so that you can manage the many personal matters which arise immediately after a loved one passes away. Our services are available regardless of whether or not there is a Last Will & Testament. In addition, we can discuss the avenues available to you if the estate has many creditors. If a dispute has arisen among family members and/or beneficiaries, we can represent your interests through litigation and hearings in the probate courts. Our firm routinely handles a variety of probate matters including the following:

• Petitions for Letters Testamentary
• Petitions for Letters of Administration
• Petitions for Year’s Support
• Affidavits of Descent
• Executor’s Deeds
• Agreements among heirs
• Renunciations and Assignments
• Petitions to Remove An Executor or Administrator
• Releases from beneficiaries
• Transfers of title to real or personal property

A separate part of our probate practice involves obtaining guardianships and/or conservatorships over adults. Most often, these occur when adult children are seeking guardianship/conservatorship over their elderly parents who are suffering from dementia, Alzheimer’s, a stroke or are otherwise unable to make significant responsible decisions with their finances and their personal care. We assist you in obtaining all the powers Georgia law allows so that you can properly care for your loved one.

We also help individuals seeking guardianship and/or conservatorship for a minor child who has lost his or her parents or whose parents are unable to care for him or her. We will ensure you have the tools available under the law to properly raise and care for the child.
